There was a guy on Puerto marino who had built a "temporary " building which got progressively bigger each year on his solarium probably 10 years ago. Whether it was the original neighbours or new owners it appeared on the annual agm last year and this easter he was lowering the roof height so the neighbours view was restored. The decision was nothing actually nothing to do with the view but solely that no permission was initially granted as is so often the case. On speaking with spanish friends i think its more a cultural case of rules are there to be ignored unlike the brits who generally tend to follow them.
They dont like it up em !

Hi Teamkruuse, obviously I don't know how your community works, I've served on the management board of our community and have learnt a few things as a result of this.
One of my first big learnings was how powerful the president can be.....basically if the president says jump the administrators reply is "how high"
We had one president who did "illegal" things including using "black labour", that is no receipts, cash in hand, you get my drift......we've now had written into the constitution that nothing illegal can be done.
On our community to limit the power of the president everything out of the normal is to be discussed  and voted on at a management board meeting.....held about every six weeks, consisting of president, Vice President and four board members......the administrator is there in an advisory role.
If on our community people had been building on their roofs the administrator would explain to us if this was legal or not dependent on the construction, we as a board would decide what action should be taken, the administrator would advice us how we could do this and the stages/costs involved in doing so.

So what I would recommend is that you and your neighbours all write to your administrator, president, Vice President and board members demanding that this topic to be on the agenda at the next community board meeting and at the AGM with details of the action that can be taken. Armed with this information a vote can be taken

Legally you have the right to present motions for the vote of other members.

He who shouts loudest gets heard

I will try to get   GranAlacant magazine to bring an article about this issue in there next edition :) 8)

I do not live in altomar II, but recently we applied to Santa Pola council for a license to build a small sympathetic extension on our solarium ( similar to a conservatory).
 We had a meeting with the town architect who said, it is completely forbidden to build on a solarium! Yes you can build on a balcony but only with special conditions. As someone else has written, the only thing you can put on a solarium is a wall mounted awning. Not even gazebo type awnings!

 He pulled up google view of our urbanisation and others, and pointed to all the things that were illegal. They will eventually all be fined/demolished

 He was very pleasant and even sympathetic but warned against, just building with  a minor works permission from the urbanisation. The amnesty period has been extended from  five to fifteen years! and  these days most illegal builds end in not only a fine but also a demolition order! We considered this to be too risky to proceed.

Another interesting snippet- for many years you did not need permission for extensions  that could be dismantled i.e. were not built of concrete, bricks or tiles, for example a conservatory, . This has now changed to if it keeps out rain you need permission!

We have only managed 2 meetings in the years we have lived in G.A. Like many we head away from the area for a couple of months Mid July.
If you cannot attend you can ask someone to be your proxy voter, but make sure they agree with your views. The other way to say yes or no to a point is to e-mail Gestifinc  on the form they send with the Agenda, or even without your form, if you feel strongly about any point, e-mail them a,s.a.p.
As for debating anything, good luck with that, the majority of people at the meeting when we went were the Spanish and others who own houses, but only visit for one month in summer, they are the ones who get heard the most, not the others who live there most of the year. If you have not been to a meeting yet, suggest you take food and drink, it can go on and on!!

yes i can remember the a.g.ms when we lived there it goes on for so long untill most people get fed up waiting to get things sorted so they leave then all the spanish are left then they vote ,you must stick it out all the way it can also be very funny with translators getting things wrong that hold the meeting up as well as denrose say take food and drink , enjoy

Interesting article - with an overall return on their "investment" in staff etc of 16:1, I would expect this campaign to keep on going for a while yet.
